Can I claim compensation if I am injured by an untraced driver?

What should you after the accident?
Immediately following the accident you should do the following:
- Get as many details as you can about the other driver. This should include vehicle registration number, any contact details that it’s possible to obtain, and the make/model of the car.
- Obtain details of any witnesses who were at the scene. This includes full name, address, and a contact number.
- Report the accident to the police within 14 days if you are making a claim for injury, or within 5 days if you are making a claim for damage.
- Report your accident to your insurance company.

Can you still act for me on a no win no fee basis?
Yes, we can act for you on a no win, no fee basis under a Contingency Fee Agreement. If you are the victim of a driver who is untraced we can still act for you. However, we will agree to take a proportion of your damages to fund our costs. The reason for this is that the Motor Insurers Bureau will only pay a contribution towards our costs upon conclusion of the case. However, don’t worry if your claim is unsuccessful. If you do not win we will not charge you anything, provided that you have acted reasonably with us.
How do you pursue an untraced drivers claim?
Firstly, we make the necessary enquiries to confirm that the driver was actually untraced. We will then submit a claim on your behalf to the Motor Insurers Bureau. The MIB will confirm receipt of the application as soon as possible and investigate the matter further. They will then reach a decision as to whether to accept the claim. We will advise you all the way. The Motor Insurers Bureau normally obtain medical evidence if they are satisfied that a claim exists. They will then provide an offer.

If it seems that there will be a long delay in settling your claim (due to the extent of your injuries) then the MIB will consider making an interim compensation payment. We will make a request for this on your behalf.
