Pedestrian Accident – £12,000 in Compensation

Mrs. B reached out to Oliver & Co following her involvement in a pedestrian accident, prompting Allison Pepper to take charge of her claim.

Mrs. B, was wearing a fluorescent green top, patiently waited at a junction for another vehicle to make a right turn before commencing her crossing. However, midway through the road, she was struck by the defendant’s vehicle approaching from her right, causing her to bang her face on the vehicle’s surface and subsequently land on the ground.

As a result of the accident, Mrs. B sustained damage to one of her front teeth, necessitating splinting and dental intervention, alongside soft tissue injuries to her face, bruising to her right side. She developed a fear of cars. Liability was acknowledged by the defendant’s insurers, facilitating the progression of the claim.

To advance the claim, medical evidence was important. A Dentist was engaged to assess Mrs. B’s condition and prepare a dental report. The repositioning of her front tooth, splint application, and root canal treatment were required. The dental report indicated a favourable long-term prognosis for the tooth, estimating its stability for at least the next decade, albeit with a 30% risk of root resorption within that period and evidence suggesting a 20% survival rate for root-treated teeth after 20 years. On this basis it was felt likely that the root canal treatment would need repeating once during our client’s lifetime.

With this information in hand, the claim was settled amicably within 12 months of the accident, negating the need for court proceedings. Mrs. B was compensated with over £12,000 for her injuries and financial losses.
