Helping a client who suffered an avoidable still birth

We recently assisted our Client who had suffered an avoidable stillbirth. Our Client was a first-time mum, whose pregnancy had progressed normally until the pregnancy fell overdue. She reported reduced fetal movement and had an abnormal CTG scan, the Defendant failed to act upon this, furthermore the Defendant failed to appreciate the presence of significant meconium in light of fetal tachycardia and reduced fetal movements.

Our Client was negligently discharged, without being treated by immediately inducing of labour. When she returned to hospital her baby had sadly passed away and our Client subsequently suffered the agony of labour to deliver her stillborn baby. An investigation conducted by the HSIB (Healthcare Safety Investigation Branch) highlighted numerous concerns with the care provided to our Client.

The HSIB investigation report alongside our Client’s records were reviewed and considered further by our dual qualified doctor and solicitor, we created a chronology of events and took a witness statement from our Client. We then instructed an independent Consultant Psychiatrist to comment on the degree of psychiatric harm the Client suffered as a result of the negligence. A Letter of Claim was sent to the Defendant to which they responded with some admissions of liability.

Our Solicitors entered into hard fought negotiations which ended successfully when we were able to recover £38,000 in compensation for our Client. Not only did our solicitors assist our Client with a traumatic claim for compensation, but we were also able to provide support and compassion to our Client throughout their second pregnancy, an understandably worrying experience for our Client.
