Last week, our specialist Industrial Disease solicitors, James Cameron, Hannah Higson, and Eve Halliday attended the Merseyside Asbestos Victims Support Group (MAVSG) Asbestos Conference.
The conference brought together legal professionals, medical experts, health and safety practitioners, and support organisations from across the asbestos sector. It provided an excellent opportunity to hear about recent legal developments, emerging issues in asbestos litigation, medical advances, and the support available to legal professionals when dealing with these highly emotional and sensitive claims.
Supporting Those Affected by Asbestos Disease
The Merseyside Asbestos Victims Support Group (MAVSG) plays a vital role in supporting individuals and families affected by asbestos-related diseases across Merseyside and the surrounding areas. The charity provides free practical and emotional support to those diagnosed with conditions such as mesothelioma, asbestosis, diffuse pleural thickening, asbestos-related pleural effusion, and asbestos-related lung cancer. MAVSG assists clients in accessing benefits, securing medical and care support, and understanding their legal rights, while also offering guidance to family members during what is often an extremely difficult time.
Key Legal Developments
Throughout the day, James, Hannah and Eve heard from a range of knowledgeable and experienced speakers who shared valuable insights into both the legal and practical challenges faced by asbestos victims and their families.
One of the keynote presentations was delivered by Rachit Buch, Barrister, of 12 King’s Bench Walk, who discussed lost years claims following the Court’s decision in the case of CCC. His talk explored how the judgment may affect personal injury claims involving infants and the implications this could have for the valuation of future claims. The session provided a thought-provoking analysis of an evolving area of law and highlighted the importance of keeping abreast of judicial developments.
We also heard from Ian Bailey of KP Law, who provided an update on the ongoing Johnson & Johnson group action talc litigation. Ian outlined the current status of the proceedings and discussed the conditions that may be associated with talc exposure. His presentation also examined the geology and composition of talc, helping attendees better understand the scientific issues that underpin these complex claims.
Understanding Low-Level Asbestos Exposure
Dave Maddison, Health and Safety Practitioner at Pragma & Associates, delivered an engaging presentation on low-level asbestos exposure. His session explored the current evidence surrounding low-dose exposure and the challenges that can arise when assessing causation and risk. The discussion highlighted some of the uncertainties that continue to exist in this area and the impact these can have when investigating and pursuing asbestos-related claims.
Medical insight was provided by Dr Michael Beckles, Consultant Respiratory Physician, who spoke about the various diseases linked to asbestos exposure, including mesothelioma, asbestosis, diffuse pleural thickening, asbestos-related pleural effusion, and asbestos-related lung cancer. Dr Beckles discussed the risks associated with low-dose asbestos exposure and shared his expertise on diagnosis and the medical evidence often relied upon in litigation.
Wellbeing in the Legal Profession
The conference also included an important session from Ishbel Straker, who addressed the topic of vicarious trauma within the legal profession. Her presentation focused on the emotional impact that working with traumatic cases can have on professionals, how the signs of vicarious trauma can be recognised, and the steps organisations can take to support the wellbeing of their staff.
This was a particularly insightful session and an important reminder of the need to prioritise mental health within the workplace, especially for those who regularly support individuals and families facing life-changing diagnoses and circumstances.
