When family relationships break down, situations involving domestic abuse and disputes over children can quickly become overwhelming and emotionally distressing.
We acted for a mother who raised serious concerns about controlling and abusive behaviour during and after the breakdown of her marriage. She alleged ongoing intimidation and harassment following separation, including unwanted contact, interference with the sale of the family home, and behaviour which caused significant anxiety for both her and the children.
The situation became particularly urgent when the father failed to return the children following contact.
Taking Immediate Legal Action
Our client needed urgent legal protection for both herself and her children.
She had already secured a non-molestation order, preventing the father from:
- using or threatening violence;
- intimidating or harassing her;
- making unwanted contact outside agreed arrangements; and
- attending the family home or surrounding area except for agreed child contact.
Communication between the parties was restricted to solicitors in relation to arrangements for the children.
Following the father’s failure to return the children, we acted swiftly by making an urgent court application seeking:
- the immediate return of the children;
- temporary child arrangements confirming where the children should live; and
- a prohibited steps order to prevent the children being removed again without agreement or court permission.
The Outcome
The court ordered the immediate return of the children to their mother on the same day.
The court also:
- confirmed that the children would live with their mother on an interim basis;
- put structured contact arrangements in place for the father;
- made a prohibited steps order preventing the children from being removed again without consent or court approval; and
- established clear arrangements for communication, handovers and future proceedings.
Why This Result Mattered
For our client, the outcome provided immediate protection, reassurance and stability during a highly stressful period.
The urgent court orders helped:
- safeguard the mother and children;
- restore the children safely to their primary home;
- prevent further unauthorised removal of the children; and
- create clear boundaries and arrangements while longer-term decisions were considered by the court.
This case demonstrates how the family courts can use both protective injunctions and child arrangements powers together to respond quickly in urgent situations involving domestic abuse allegations and children.
