We were instructed by a father in respect of his daughter. At the time of the instructions, his daughter was nine months old.
When the child was born, the parents were not in a romantic relationship. Because of this, when the mother registered the child’s birth, the mother did not include the father’s name on the child’s Birth Certificate and therefore, the father did not obtain Parental Responsibility for the child. The mother automatically obtained Parental Responsibility for the child.
Applications to Court for Parental Responsibility, and Contact
We advised the father that to obtain Parental Responsibility, he would be required to apply to court for a Parental Responsibility Order.
Alongside not being named on the child’s Birth Certificate, he was not having regular contact with his daughter and therefore, we advised the father to apply for a Child Arrangements Order, alongside his application for a Parental Responsibility Order.
After two hearings at the Family Court, the father successfully obtained a Parental Responsibility Order and a Child Arrangements Order in respect of his daughter. Once the father had the Parental Responsibility Order, we assisted the father with the administrative task of amending the child’s Birth Certificate to name him on the certificate.
Placed on Equal Footing
Because of our help and legal advice, the father was provided with security moving forwards that he had Parental Responsibility for the child and was therefore able to make important decisions for the child in respect of their health, education, and day-to-day matters, on an equal footing with the child’s mother.
