Financial settlements after divorce can be particularly complex when children, health issues and housing needs are involved.
We acted for a mother in financial remedy proceedings following the breakdown of her marriage. The family had three children, all of whom had significant additional needs and ongoing medical or developmental challenges.
Our client was also dealing with serious health conditions which affected her mobility and prevented her from working. Medical evidence confirmed that she was not fit for employment at the time.
Protecting Stability for the Children
One of the most important issues in the case was the future of the family home.
The mother and children remained living in a property that provided stability, familiarity and practical suitability for the children’s additional needs. The evidence showed that if the home had to be sold, our client would struggle to secure a mortgage or find suitable alternative accommodation in the same area.
Much of her income came from benefits and was financially uncertain, whereas the husband had a significantly stronger earning capacity and borrowing position.
Our focus throughout was on securing a practical solution that protected the children’s welfare and long-term stability.
The Outcome
Following detailed negotiations, we successfully reached an agreement without the need for a contested final hearing.
The settlement allowed:
- the family home to be transferred into the mother’s sole name;
- the children to remain in a stable and familiar environment;
- an affordable lump sum payment to be made to the husband; and
- a full and final financial settlement following the divorce.
Importantly, the agreement avoided a forced sale of the property at a time when suitable alternative housing would have been extremely difficult to secure.
Why This Result Mattered
For our client and her children, remaining in the family home provided much-needed certainty and continuity during an already difficult period.
The outcome helped avoid disruption to:
- the children’s schooling;
- medical treatment and support services;
- established routines and care arrangements; and
- important local support networks.
This case highlights the importance of taking a realistic, needs-based approach to divorce financial settlements rather than focusing solely on dividing assets equally. By reaching an agreement through negotiation, we were also able to avoid further court proceedings, reduce costs and provide a clear path forward for the family.
