Maria Pilkington from our Personal Injury Team has successfully settled a claim for Mr. K, a 58-year-old cyclist, who was injured in a road accident when he was knocked off his bike.
The Accident
Mr. K, an avid cyclist, was riding his bike along a quiet country lane when a car overtook a jogger and swerved into his path. The driver, who was traveling in the opposite direction, ended up on the side of the road where Mr. K was cycling. In an attempt to avoid a collision, Mr. K sharply applied his brakes, causing him to be thrown from his bike and onto the road.
Injuries and Impact
As a result of the accident, Mr. K suffered several injuries, including:
- A soft tissue injury to his right elbow
- A sprained little finger on his right hand
- Soft tissue injuries, bruising, and grazing to his right hip
- Pain in his right little toe
Following the accident, Mr. K attended hospital for treatment. His injuries affected his ability to lift objects and disrupted his sleep.
The Claim
We initiated a claim through the Ministry of Justice Claims Portal, and the driver’s insurers quickly admitted responsibility for the accident. An independent medical expert was consulted, who confirmed Mr. K’s injuries and prepared a report.
In addition to his injuries, Mr. K’s bicycle was also damaged in the accident. Although the damage appeared minor at first, the bike, which had a carbon frame, was deemed beyond repair and unsafe to ride. Unfortunately, the manufacturer of his bike had gone out of business, making it impossible to replace it with the same model. However, we were able to secure quotes for similar bikes, and Mr. K was awarded compensation for a replacement.
We also recovered compensation for the damage to his clothing, including his gloves, shorts, helmet, and shoes.
Final Settlement
