Our personal injury team recently settled a claim on behalf of the Estate of a young man who tragically died at the age of 17 due to a road traffic collision. The young man’s mother, our client, enlisted the help of Allison Pepper, a solicitor in our team, to recover damages for funeral expenses and the pain and suffering resulting from his immediate death.
Circumstances of the incident
The young man was riding a moped home from work when he was struck from behind by the defendant driver, who was later convicted of dangerous driving. The impact caused severe injuries, including traumatic subarachnoid haemorrhage in the frontal region, subdural haematoma, extensive facial fractures and spinal injuries. Tragically, his injuries were so severe that he died within two days of the collision.
Claim process and settlement
A claim was brought by his Estate for damages for pain and suffering, funeral costs and the cost of a proposed memorial bench at his former school. Under the Fatal Accidents Act, the parents were entitled to a bereavement award, which was set at £15,120. Despite the limited statutory bereavement award, Allison successfully negotiated a total settlement of over £22,000 for the Estate. In addition to the settlement, Allison provided pro-bono assistance to recover a pay out from the client’s insurance policy, which included a £25,000 payment in the event of death.
