Supporting a Bereaved Family Following a Fatal Coach Collision

At Oliver & Co Solicitors, we recently acted on behalf of the estate of a child who tragically lost their life in a road traffic accident involving a coach.

No legal claim can ever compensate for the loss of a child. Our role was not only to pursue a claim on behalf of the estate, but also to support the family through a legal process they never expected to face, providing clear advice and guidance at an incredibly difficult time.

Following detailed investigations and negotiations with the coach operator’s insurers, the claim concluded with a settlement of £25,000.

The Road Traffic Accident

The collision occurred when a coach left the road and rolled down an embankment.

Tragically, the child sustained catastrophic head injuries and died as a result of the collision. Medical evidence later confirmed that the injuries were unsurvivable and that death would have occurred very quickly.

For the family, understanding what had happened and obtaining answers became an important part of the journey following their loss.

A Sensitive and Complex Fatal Accident Claim

Fatal accident claims require careful handling, both legally and emotionally.

In this case, the claim was made on behalf of the child’s estate against the coach operator and its insurers. Although the defendants engaged with the claim, they did not formally admit liability, meaning the evidence had to be examined in considerable detail before the matter could be resolved.

Alongside the compensation claim, the family also had to navigate the inquest process.

We supported them throughout, explaining each stage of the proceedings in plain English, ensuring they understood what to expect and helping to ease some of the burden during an incredibly distressing time.

Investigating the Circumstances of the Collision

Building the claim required a thorough investigation into the cause of the accident.

Our team reviewed a wide range of evidence, including:

  • Police investigation material
  • Medical records
  • Forensic evidence
  • Information relating to the driver’s medical history

The investigation identified several issues requiring careful legal consideration, including questions surrounding the driver’s medical condition and reporting obligations.

Although the circumstances of the collision were complex, our priority throughout was to ensure the family’s interests were fully protected while seeking answers on their behalf.

Bringing the Claim to a Conclusion

Following detailed negotiations, the claim concluded with a settlement of £25,000 for the child’s estate, avoiding the need for further court proceedings.

While financial compensation can never lessen the grief experienced by a bereaved family, resolving the legal claim provided a sense of closure and ensured the family’s legal rights were recognised.
