£16,700 Settlement for Client Following Crush Injury on Construction Site 

The Incident 

Our client, aged 56 from Manchester was working on a construction site trying to lift a road plate so that straps could be placed underneath it.   

A colleague was using a shovel to lift one side of the plate. However, the shovel either slipped or was let go, causing the heavy metal plate to fall. Unfortunately, it fell and landed on our client’s right thumb and middle finger, trapping them. 

Who was Responsible? 

We brought a claim against the employer because they did not have a safe system of work in place for handling the road plate. 

In addition, the employer was responsible for the actions of the colleague involved in the accident. This is known as being “vicariously liable,” meaning employers are accountable for mistakes made by their employees while at work. 

After negotiations, the employer’s insurers accepted responsibility for the accident. 

Medical Evidence and Impact 

To support the claim, we obtained expert medical evidence from a Consultant Plastic and Hand surgeon. 

The medical expert confirmed that our client had suffered: 

  • Damage to the nail of his right thumb 
  • An injury to the tip of his finger 
  • Ongoing symptoms including reduced grip strength 
  • Pain and numbness, especially in cold weather 

The Compensation Claim 

A claim was brought for compensation for: 

  • The physical injuries our client suffered  
  • The impact the injuries had on our client’s future work opportunities 

Fortunately, our client had not suffered any loss of earnings or other out of pocket expenses as a result of the accident. 

The Outcome 

Following negotiations with the Defendant’s insurers, we successfully settled the claim and our client was awarded £16,700 in compensation.
