Oliver & Co Solicitors recently secured a settlement of £45,000 for a client in their 30s who was injured as a pedestrian after being struck by a motorcyclist while crossing a busy street in London.
Who Was Liable
The claim was settled before court proceedings were needed, with the other side accepting that they were mainly responsible for the accident. It was agreed that the client would receive 85% of the compensation, as the client was found to be partly responsible as well.
Injuries
Our client sustained serious injuries, including fractures of the tibia and fibula, which required two surgical procedures.
As a result, they were unable to work for a considerable period of time. Fortunately, they continued to receive their full salary during their absence and, given the nature of their job, the accident was not considered likely to affect their future employment prospects.
The Outcome
Expert medical evidence was obtained from specialist lower limb surgeons to support the claim and a detailed schedule of loss was prepared. This included compensation for care and assistance provided by family members during recovery as well as travel expenses, rehabilitation aids such as ankle supports, private medical treatment, and the potential cost of future surgery.
