£55,000 Compensation for Motorcyclist Injured in Collision 

Our client, a 63-year-old motorcyclist, was seriously injured in a road traffic accident when another driver failed to give way at a traffic light-controlled junction. The defendant turned right, directly into our client’s path, causing a severe collision. 

As a result of the accident, our client sustained a comminuted fracture of the right distal radius, extending into the wrist joint, along with soft tissue injuries.  

His condition was complicated by delayed and malunion of the fracture, which affected his grip strength and ability to perform fine motor tasks such as writing, using cutlery, and typing. Although he continued to work, he experienced significant discomfort when using a keyboard. 

We successfully obtained an admission of liability before issuing court proceedings. Multiple interim payments were secured to support our client’s medical needs, including funding for surgery. However, as his condition progressed, surgery was no longer deemed the best course of action. 

Our client’s recovery was further complicated by the COVID-19 pandemic, which delayed access to NHS treatment. After being discharged from physiotherapy with no further options, we arranged a private consultation. Unfortunately, errors in radiology reports further delayed treatment, requiring corrective action by a private surgeon. 

Expert evidence initially suggested the need for wrist surgery, and an interim payment was secured for this. However, due to several factors—including our client’s ability to manage daily activities, his reluctance to undergo wrist fusion surgery, and the natural deterioration of the wrist—medical advice changed, and alternative treatment options were considered. 

We successfully claimed for our client’s out-of-pocket expenses, including the costs of private treatment, and secured compensation for future loss of earnings due to his ongoing impairment. The defendant challenged elements of the claim, arguing that our client had not mitigated his losses, but we strongly contested these arguments. 

Court proceedings were issued and before the trial, we negotiated a £55,000 settlement—ensuring our client received the compensation he deserved to support his long-term recovery.
