When Mr D first contacted our team, he was grieving the recent loss of his brother, who had tragically died from mesothelioma, an aggressive and incurable cancer caused by asbestos exposure.
Understanding the Asbestos Exposure
Mr D’s brother spent much of his working life as an industrial window cleaner employed by C J Lewis & Sons. He undertook this role from the mid-1970s through to 2001. Mr D had worked alongside his brother for many years and was therefore able to provide detailed, first-hand evidence about the working conditions that ultimately led to asbestos exposure.
A significant portion of their work involved regular visits to the Turners Asbestos Cement factory in Widnes, a site known for manufacturing corrugated asbestos roofing materials. On a monthly basis, they would spend two full days cleaning both internal and external windows while the factory was fully operational.
The environment was heavily contaminated with asbestos dust, which settled across the windows and surrounding areas. Throughout this time, neither man was provided with protective equipment or respiratory protection, leaving them unknowingly exposed to serious health risks over many years.
A Sudden and Devastating Illness
Until late 2022, Mr D’s brother had enjoyed generally good health, however, after developing a persistent cough, he sought medical advice in December of that year. What was initially believed to be a minor chest infection was later identified as mesothelioma.
Despite treatment and procedures to drain fluid from his lung, his condition worsened rapidly and he sadly passed away only a few months after his diagnosis.
Pursuing a Legal Claim
As the executor of his brother’s estate, Mr D instructed our specialist asbestos claims team to investigate and pursue compensation. A claim was submitted to the insurers of C J Lewis & Sons, supported by strong occupational evidence.
Liability was admitted at an early stage, acknowledging that the asbestos exposure had occurred during the course of his brother’s employment.
