Successful Recovery of £41,000 Compensation for our Client after Medical Negligence During Hand Surgery  

At Oliver & Co Solicitors, we are pleased to have assisted another of our clients in achieving compensation for the medical negligence suffered during hand surgery.   

Screws Too Long 

Our client suffered a fall, which resulted in her sustaining fractures to her ring and little fingers. She underwent surgical manipulation. Sadly this was unsuccessful, and her little finger began migrating under her ring finger. She was referred to the Defendant hospital for further treatment, and she underwent further surgery by way of a trapeziectomy and an osteotomy of the little finger.  

She immediately couldn’t move her little finger, and a few weeks later, an x-ray confirmed that the metal plate was trapping her tendons, and she needed further surgery to correct this. It was later found that the screws that had been used in the previous surgery were too long.  

Following the corrective surgery, our client was referred to a hand specialist, who performed tendon graft surgery from her wrist. Her symptoms have improved, but she sadly still has migration of the little finger and ongoing pain and restrictions. It is likely that she will require further surgery in the future.  

Our Investigation: Negligent Surgery and Surgical Errors  

We obtained evidence from an independent Consultant Hand Specialist, who was of the view that it was negligent for the screws to have been inserted too long and for this not to be recognised on the x-rays taken during the operation. His view was that this had caused our client’s tendons to be trapped, which had led to permanent tendon damage and led to the need for tendon graft surgery, ongoing pain and restrictions and the likely need for further surgery in the future.    

Compensation for Prolonged Pain and Suffering   

Despite the Defendant denying that they had acted negligently, we were able to successfully negotiate settlement of the claim for £41,000 in compensation for the avoidable pain and suffering and unnecessary operations required by our client.
