We recently settled a unique claim for a pedestrian who was injured when a piece of glass fell from the defendant’s vehicle. The client contacted Oliver & Co and enlisted Allison Pepper, a solicitor in our Personal Injury Department, to handle the claim.
Incident and injuries
The defendant in this case was a glazing company. A piece of glass from their vehicle struck our client on the head, resulting in a range of injuries, including headaches, brain fog, dizziness, concussion, fatigue, a severely bruised arm, and psychological injuries.
Medical evaluation
To support the claim, medical evidence was obtained from various specialists:
- Orthopaedic Surgeon: Confirmed a mild contusion head injury that resolved within 3 weeks, headaches lasting 2 months, and a shoulder injury lasting 3 weeks.
- Psychologist: Diagnosed the client with an anxiety disorder directly attributable to the accident. The psychologist recommended Cognitive Behavioural Therapy (CBT), predicting full recovery by the end of the therapy with no risk of the injury impacting the client’s employment.
Settlement
The defendants’ insurers agreed to cover the cost of the recommended therapy. Additionally, they offered a sum of £5,000 in full and final settlement for the client’s injuries and financial losses. This settlement provided our client with the necessary resources to recover fully from the accident.
