Knee and Facial Injuries at Work – £10,000 in Compensation

Kathryn Bull, a specialist in our Personal Injury Team successfully settled a claim for our 67-year-old client for £10,000.

Our client was a self-employed mobile service engineer contracted by the defendant to attend their premises. At the entrance of the premises there was a barrier to stop vehicles passing through. There was a pedestrian walkway to one side and our client tripped and fell due to potholes within the pavement caused by loose concrete. This provided an uneven surface and as a result our client fell forwards into the metal barrier causing a laceration to his face and soft tissue injury to both knees.

Our client was a lawful visitor to the defendant’s premises having been invited by them to carry out maintenance work and pursuant to the Occupiers Liability Act, the defendant admitted responsibility, agreeing to pay our client compensation for his injuries and any associated financial losses.

We arranged for our client to be examined by an Orthopaedic Surgeon to prepare a medical report confirming the injuries sustained. The expert concluded that our client sustained facial lacerations together with an aggravation of pre-existing but asymptomatic degeneration to both knees which would have been present before the accident.

Our client was off work for four weeks due to the accident-related injuries and, as he was a self-employed engineer, he suffered a loss of earnings which were included as part of his claim; as were his damaged spectacles which required replacement.

Our client was happy to accept the sum of £10,000 in settlement of his claim and provided the following comment:
