Our personal injury team settled a claim on behalf of the Estate of a young man who died at the very young age of 17 as a result of a road traffic collision. The parents of the family were also entitled to bereavement damages as the deceased died at such a young age. Sadly, our client had been riding a moped on his way home from work when he was hit from behind by the defendant driver who was later convicted of dangerous driving.
He suffered a traumatic subarachnoid haemorrhage in the frontal region, a subdural hematoma, extensive fractures to his face and spinal injuries and unfortunately died within 2 days of the collision. Under the Fatal Accidents Act the parents were entitled to a bereavement award which was set at the derisory figure of £15,120. This was agreed. The deceased was not married and was living with his parents at the time of his death. Allison achieved settlement for over £22,000. She also assisted on a pro-bono basis to recover a pay out from the client’s insurance policy which included a payment in the event of death of £25,000.
