Severe Spinal Stenosis and Symptoms
Our client was suffering from severe spinal stenosis at level L4/5 and was advised that he required a decompressive lumbar laminectomy. However, during the surgery, the operation was in fact negligently carried out at L3/4. A dural tear was caused during the operation, resulting in damage to the underlying nerve roots. Our client suffered a CSF leak and debilitating headaches. He also continued to suffer with severe symptoms as a result of the failure to correct the stenosis at level L4/5.
Dural Tear was Avoidable
We obtained evidence from an independent Consultant Neurosurgeon, who was of the view that it was negligent for the surgery to have been carried out at the wrong level, and the dural tear was avoidable. He was dismayed that our client had not been offered further surgery at the correct level, but due to subsequent illnesses, he is now no longer able to consider such invasive surgery.
Compensation for Prolonged Pain and Suffering
The Hospital Trust ultimately admitted liability for the wrong level surgery, but denied that the dural tear was avoidable and were of the view that our client’s ongoing restrictions were mostly due to his other non-related illnesses. Following a settlement meeting with the Defendant’s legal team, our client was awarded £65,000 in compensation for his avoidable pain and suffering and associated financial losses.
