We have settled a claim for an 80-year-old woman from Cheshire who was injured whilst she was stood on the pavement waiting for her husband to collect her in his car following a shopping trip.
Our client was stood on the pavement when a gust of wind caused a large metal gate which was behind her to blow open onto the pavement knocking our client over.
Our client fell to the ground and sustained a fracture to her leg (femur) for which she needed to have surgery.
Initially a claim for compensation was brought against the registered owner of the premises of which the gate was part, but they denied any responsibility and instead blamed the tenants who were occupying the premises at the time. We then pursued the tenants (a restaurant) who in turn blamed a management company who was employed to manage the communal areas surrounding the building. They in turn denied responsibility/liability and blamed a security company who were responsible for security at the premises. The security company also denied that the accident was their fault.
To progress the claim for our client we had to commence court proceedings against all four potential defendants. We were adamant that one of the defendants should take responsibility for what had happened and eventually one of the four defendants agreed to deal with the claim.
A medical report was obtained from a Consultant Orthopaedic surgeon who examined our client and prepared a written report detailing our client’s injuries and giving a prognosis or them.
We were pleased to be able to settle our client’s claim for £23,500 which included not only compensation for her injuries but compensation for the help and care that her family had provided to her whilst she was recovering from her injuries.
