At Oliver & Co, we have recently successfully challenged a decision made by the Motor Insurers’ Bureau to reject our client’s claim and recovered £100,000 for him.
The Incident
Our client was seriously injured in an unexpected road traffic accident while waiting for his car to be cleaned at a car wash in Wales.
As he stood in front of his vehicle, an employee of the car wash asked for his keys and moved the car to allow more vehicles to enter. However, after repositioning the vehicle, the worker failed to apply the handbrake. Since the car was on a slope, it began rolling forward unattended, ultimately trapping our client between his car and a nearby house.
The accident resulted in severe injuries, including:
- A fractured left humerus, shoulder blade, and clavicle
- Pneumothorax (collapsed lung)
- Multiple spinal fractures requiring fixation
- An undisplaced sternal fracture and rib fractures
- An abdominal intimal tear
- A degloving injury to his left armpit
Despite the seriousness of his injuries, our client made a remarkable recovery and was able to return to work as a plasterer.
Identifying who was responsible
The main legal challenge in this case was identifying the responsible party. The individual who moved the car provided false information to the police, and both he and the operators of the car wash business disappeared from the country, making it impossible to trace them.
To ensure our client still received justice, we submitted a claim to the Motor Insurers’ Bureau (MIB) under the Untraced Drivers Agreement. Initially, the claim was rejected, but we pursued an appeal.
After a successful appeal and negotiations, we secured a favourable settlement for our client—ensuring he received the compensation he deserved for his injuries and losses.
