Accident at Work – £4,073 in Compensation

Our Personal Injury team at Oliver & Co were very pleased to settle a claim for Mrs T, a 45-year-old woman from North Wales who was injured at work whilst working in a factory. Part of the conveyor belt on the line where she was working was designed such that it could be lifted to allow her to walk underneath. When opened it was meant to stay in an upright position.

On the day of the accident our client walked through the gap with a cage trolley full of goods. The line fell hitting her on the head. The machine was later found to be defective and was repaired.

Our client suffered injuries to her neck, back, shoulders and had concussion.  She also suffered psychological injury in the form of chronic post-traumatic stress and was off work for approximately two weeks.

A claim for compensation for her injury and financial losses was brought against her employers and was submitted via the Ministry of Justice Claims Portal. Liability was admitted by her employer’s insurers and to prove her injuries were caused by the accident our specialist solicitor obtained medico-legal reports from independent medical experts including a psychologist.

As well as a claim for the physical and psychological injuries we also claimed loss of earnings and for the care she required from her family whilst recovering from the accident-related injuries. Thankfully, our client recovered well from her physical injuries in 6 weeks and her psychological injury in 6 months. Settlement was achieved for our client of £4,073 – a very good outcome!
