We settled a claim for compensation for Miss B, a 24-year-old woman from Cheshire who sustained an injury her finger whilst at work.
Our client was working part time as a general assistant at a residential home. She had been asked by her manager to put out the rubbish bins for collection. The bins were stored in a sort of wooden shed/bin store. As she did this a large splinter of wood became caught in the middle finger of her left hand. She washed and treated her hand and had thought she had been able to remove the splinter.
However, the following day her finger had become swollen, and she began to feel generally unwell. It later transpired that she had developed an infection and was admitted to hospital and a surgical wash out procedure was carried out.
Fortunately, our client made a good recovery from her injuries and has been left with only minimal scarring.
A claim was brought against her employers as they had failed to provide her with a safe place of work as clearly the wooden bin store was defective. They had also not provided her with adequate PPE (Personal Protective Equipment) such as gloves.
Our client’s employers denied liability/responsibility, but we continued to pursue the claim as we considered that the claim had reasonable prospects of success. Despite their denial of liability, our client’s employers could not show that they had any regular system for inspecting the bin store/shed to check it was in good working order.
In support of our client’s injuries, a written medical report was obtained from a plastic surgeon who specialised in hand injuries, and he was able to detail our client’s injuries and give a prognosis for recovery.
We prepared ready to commence court proceedings but fortunately we were pleased to be able to settle the claim for our client for the sum of just over £3,800.
