Accident at Work – £98,000 in Compensation

Mr. H, a 26-year-old resident of Merthyr Tydfil, experienced an accident while at work. Employed at an abattoir, he operated a pneumatic circular saw. During the course of work, his colleagues engaged in playful behavior, squirting water. Unfortunately, Mr. H suffered a severe laceration to his left, non-dominant wrist, resulting in nerve damage that necessitated surgery. The defendants in this case, his employers, were found vicariously liable for the actions of their employees.

Although Mr. H returned to work after a 7-week recovery period, experts in the field of medico-legal analysis believed he faced permanent challenges in the open labour market due to persistent numbness and pain in his left hand. These symptoms limited his ability to grip, pull, lift heavy objects, and perform fine manipulations due to cold intolerance. Consequently, a claim for future loss of earnings and disadvantages in the job market was pursued, calculated based on his net annual salary for a three-year period.

The defendant disputed liability for the accident, attributing it to Mr. H’s lack of attention to his duties and blaming him for his own injuries. Despite attempts to settle the matter, court proceedings became necessary, leading to a trial where fault was adjudicated. Prior to the trial, Mr. H proposed a settlement offer of £50,000.

Following a two-day trial, Mr. H was awarded more than £98,000 for his physical injuries and associated financial losses, including interest to account for the time taken to resolve the claim.
