Our client tripped on raised flagstones on a public footpath. Unfortunately, she suffered multiple injuries to her face and also injured her shoulder.
We pursued a claim against the Local Authority, who contested, suggesting that they regularly inspected the area. If a Local Authority can prove that they have a reasonable system of inspection and that when they last inspected the area the defect was not present, then they may be able to avoid liability. However, a witness said that the defect had been present for a few years. She also said that she had pointed it out to the Local Authority in the past.
The case was settled out of court for £11,500.
