Achieving Compensation for an Overseas Asbestos Claimant 

Our team was approached to assist with a claim involving long-term asbestos exposure that occurred decades ago in the United Kingdom. The individual, referred to as Mr P, had worked in asbestos-heavy environments before relocating permanently to Australia. Despite his residence abroad, the legal claim had to be pursued within the UK jurisdiction, as the exposure took place here. 

Diagnosed with Asbestosis and Pleural Complications 

Following his occupational exposure, Mr P was diagnosed with asbestosis and a pleural effusion—both serious respiratory conditions linked to asbestos. These findings were supported by expert medical testimony and formed the foundation of his legal case. 

Tragically, Mr P passed away before the matter could be resolved. His wife continued the claim on his behalf, and we remained committed to securing justice for the family. 

Admission of Liability and Financial Resolution 

The Ministry of Defence, acting as the Defendant, acknowledged responsibility for Mr P’s exposure. He had worked as a labourer at HM Dockyard Portsmouth between 1967/68 and 1974/75, where he regularly encountered both loose and preformed asbestos aboard naval vessels under construction. 

With strong medical evidence provided by a Respiratory Consultant, we were able to negotiate a settlement without the need for court proceedings. The final compensation totalled £157,935.75. This amount covered damages for the illness itself, the unpaid care provided by Mr P’s family, and the cost of essential equipment such as a mobility scooter and vehicle.

Despite the geographical distance, we managed the entire process remotely, via phone and email, with Mr P and his family in Australia. Their location did not hinder our ability to deliver a smooth and effective legal service. 

In addition to securing compensation, we successfully applied for UK state benefits on Mr P’s behalf, including Industrial Injuries Disablement Benefit. He had initially believed his overseas residency would disqualify him, but we ensured he received the support he was entitled to.
