How the Accident Happened
The incident occurred in April 2024. Mrs D, a lawful visitor, was at the ice rink watching an ice hockey match with her husband and grandchildren. While entering the ladies’ toilets, she unexpectedly tripped and fell. The floor was covered in rubber matting, which had become torn and raised, creating a serious tripping hazard. Mrs D was unable to get up and required ambulance transport to hospital.
Why the Council Was Responsible
The local County Council, as occupiers of the leisure centre, were held responsible for failing to take reasonable care under the Occupiers’ Liability Act 1957. The key issues included:
- Failing to maintain a system to identify or repair defects in the flooring
- Allowing defective matting to remain on the floor
- Exposing visitors to a foreseeable risk of tripping
- Failing to prevent access to the hazardous area
- Breaching their common law duty of care to ensure visitor safety
- The defendant’s insurers admitted primary liability for the accident.
Injuries and Recovery
As a result of the fall, Mrs D suffered a left hip fracture. She experienced immediate pain and was unable to bear weight. X-rays confirmed the fracture, and she underwent a total hip replacement.
