A Missed Diagnosis Leading to Prolonged Suffering
Our Client suffered acute and severe pain in his testicle, and having previously suffered a testicular torsion which was not operated upon years before, he was immediately concerned that this had returned and he attended his local hospital. Despite his previous medical history and our Client himself querying whether this could be a testicular torsion, our Client was misdiagnosed with epididymitis and discharged with antibiotics.
An ultrasound scan was arranged for a few days later, which showed an ischaemic testicle due to testicular torsion. The testicle could not be saved due to the delay, and surgery took place to remove the testicle the following day.
Defendant’s Denial of Responsibility
The Defendant hospital denied liability in the claim. Their view was that the symptoms our Client presented with were not typical of testicular torsion, and in any event, surgery would not have taken place within the small window of opportunity that exists to save a testicle which has suffered a torsion.
Our Investigations
We obtained independent expert evidence which supported our Client’s case, and we were able to use this evidence to challenge the Defendant’s position.
Whilst the Defendant did not admit any wrongdoing, they did accept that they were at risk in this case, and they made an offer of settlement to our Client. Our Client was very keen to settle his claim in order to have closure on this upsetting period and be able to move on with his life, and he therefore chose to accept £10,000 in compensation for the prolonged pain and loss of his testicle.
