Negligent Failure to Follow up by the Nutrition Clinic 

Our client had a lot of abdominal health problems, including iron deficiency anaemia, vomiting, abdominal pain, constipation and blood in his stool.  He underwent multiple investigations, including operations and hospital admissions.  He was losing weight, was pale and had poor oral intake and the plan from the nutrition team whom he was under in January 2021 was for further blood tests and follow up.   

Due to administrative errors within the NHS, our client was lost to follow up by the Nutrition Clinic and was extremely unwell between February and November 2021, losing a huge amount of weight, shaking and passing out, being unable to eat, vomiting even on water and suffering from severe abdominal pain, constipation, weakness and fatigue. 

Our client became so unwell that he was admitted to hospital in November 2021 with severe ongoing anaemia and weight loss.     

Treatment 

Our client was treated in hospital by way of nasogastric feeding and responded really well with this, putting weight on and feeling better.   

Expert Evidence 

We obtained independent expert evidence from a Consultant Gastroenterologist who was of the view that our client should have received follow up months earlier, in which case he would have been prescribed food supplements and feeding via a nasogastric tube.  This could have been done with an impatient stay of only one or two nights.   

Our client would have avoided the significant symptoms he had during the period of delay and would have avoided a prolonged hospital admission. 

Liability Admitted 

The Defendant admitted that they breached their duty of care in failing to arrange follow up in the nutrition clinic between February and November 2021.  They explained that an appointment had been placed on the partial booking list but in breach of their duty of care, it hadn’t been fully booked in. 

It was admitted that this administrative error resulted in a delay in following our client up. 

Apology & Resolution 

The Defendant apologised for the substandard care. 

Our client wanted to raise awareness of the dangers of administrative errors within the NHS and the effect it can have on patients. 

Our client received £5,000 by way of compensation but hopes that by raising awareness, this will not happen to another patient in his position.
