Our client underwent a caesarean section as her vaginal delivery was not progressing as it should do. A few weeks later, she experienced significant blood loss vaginally and passed a huge clot. She attended the Defendant Trust, who diagnosed her as having her period and discharged her home.
Less than two weeks later, our client experienced a second huge surge of blood from her vagina to the extent that it gushed through her maternity pad, jeans and down her legs. She went to the toilet and passed large clots. She re-attended the Defendant Trust and was eventually diagnosed with having retained placenta requiring surgical removal.
Our expert consultant obstetrician was of the view that the retained placenta was too small to say that it was negligent to fail to have removed it at caesarean section but was of the view that it was a breach of duty of care to fail to have diagnosed retained placenta after the first heavy vaginal bleeding.
If they had made the correct diagnosis at the first attendance, our client would have had a minor procedure to remove the retained placenta and would have avoided the distressing second bleed.
Our client suffered psychologically, and our expert psychiatrist diagnosed Post Traumatic Stress Disorder and recommended treatment by way of EMDR.
A Letter of Claim was sent to the Defendant Trust and breach of duty of care was admitted but the Defendant argued that the treatment would have been the same in any event.
Despite this, the matter settled in the sum of £12,000 in our client’s favour.
