We are pleased to report a successful outcome for Miss P, who was diagnosed with mesothelioma in April 2024 following a biopsy. Unfortunately, we were unable to trace insurance for her former employer and so we assisted in pursuing a claim through the Diffuse Mesothelioma Payment Scheme (DMPS).
No Insurance? DMPS to the Rescue
Miss P had worked at Plastercraft Limited in Darwen, Lancashire, where she was exposed to harmful asbestos dust. The company later became Conver Foam Limited and was eventually acquired by the Harrison Jones Group. Despite our thorough investigations, we were unable to locate the Employer’s Liability insurance needed for a direct claim, prompting us to apply for compensation through the DMPS instead.
Exposure to Asbestos Dust
The company made foam products and Miss P recalled that asbestos-lagged pipes in the factory had become damaged over time, causing asbestos dust to accumulate on the floor. She and her colleagues regularly swept up the dust, especially after a fire at the site, creating clouds of airborne asbestos. Miss P worked in these unprotected conditions for approximately 18 months from 1976 onward, breathing in dangerous levels of asbestos dust.
Swift Action for DMPS Approval
Upon her diagnosis, we filed Miss P’s DMPS application urgently, as it was crucial to submit it before her passing; otherwise, her estate would have been unable to claim under the scheme. In under four months, the application was approved, securing nearly £170,000 in compensation for Miss P. With this outcome, she plans to retire and focus on her health and well-being.
