Car Hit Whilst Stationary in a Layby – £50,000 in Compensation

Settlement was achieved for one of our clients in the sum of £50,000 after her car was hit whilst stationary in a layby with her two children in the car. Liability was denied by the Insurers as there were considerable delays in the police completing their investigation report.

Given the nature of the accident our client had no recollection of the events leading up to the high-speed collision as she suffered serious injuries including a bleed on the brain, dental injuries and a fractured spine, fracture to the scapular and soft tissue injuries to her hip and psychological injuries.

The defendant’s insurers appreciated the risk of the claim proceeding and made an offer of £35,000 early in the case which put our client at risk of failing to beat it if she went on to recovery as it was anticipated.

For certainty and to check there would not be any future problems such as increased risk of epilepsy, our client was advised to wait to be examined by a specialist Orthopaedic Surgeon, Neurologist and Psychologist.

From the information available from our client’s medical records, it appeared the brain settled without future risk of deterioration, but we could not be absolutely sure. Shortly before the examinations took place, our client had a head and pelvis MRI which were entirely positive, and it became likely our client may not beat the offer of £35,000.

Using specialist skills, the solicitor was able to negotiate and secure settlement for £50,000 after an examination had taken place with a psychologist. The claim settled just before the examination with the Neurologist and Orthopaedic Surgeon as our client did not want to risk the further medical evidence reducing the potential value of her claim.
