In April 2022, Mr. P reached out to us after receiving the distressing diagnosis of terminal mesothelioma due to asbestos exposure. Within a few months, we successfully secured a compensation payment of £200,000 for him, which also included payment for private treatment costs.
Asbestos exposure during apprenticeship
During his apprenticeship with Yeomans & Partners Limited, a subsidiary of the Bovis Construction Group, Mr. P was exposed to asbestos. Additionally, he encountered further exposure while working for the same company after completing his apprenticeship.
We discussed Mr. P’s experiences at work, and he recalled various contracts he worked on for the company, including projects at Sloan Avenue Mansions, the Financial Times building, and the Chelsea Pensioners Hospital in Chelsea. However, one of the primary contracts he remembered was on Grantham Road, Stockwell, London, in around 1972. On this particular project, Mr. P was involved in the construction of new properties designated for old people’s homes, which required lining with 8 x 4 feet Asbestolux sheets.
As a young apprentice painter and decorator, Mr. P’s tasks included painting walls and ceilings, performing knotting work on new timbers, and filling joints while working in close proximity to joiners who were cutting the Asbestolux sheets. These sheets were placed on trestles and cut to size using handsaws or Black & Decker Stihl saws, releasing significant amounts of asbestos dust into the air, which all workers, including Mr. P, inevitably inhaled.
A detailed witness statement was prepared for Mr P to support his claim and to ensure the Defendant’s insurers were able to deal with the claim urgently, given his diagnosis.
A quick resolution with private treatment costs included
We were really pleased to be able to successfully secure a substantial sum in compensation for Mr. P’s mesothelioma claim just five months after his initial contact with us.
As a result of this successful claim, Mr. P is now entitled to receive private medical treatment, fully covered by his former employer’s insurers. While the cost of this treatment is significant, Mr. P will not bear any financial burden, as it will be covered entirely by the private settlement order we have obtained. Mr. P expressed that, although no compensation can replace his health, the funds recovered will significantly ease the burden for him and his partner as they navigate through this challenging time together.
