Fractured Finger – £5,000 in Compensation

Mr. K, from Wolverhampton, sustained a fracture to his dominant ring finger while operating a machine designed to cut plastic board parts. The incident occurred when the machine malfunctioned due to plastic parts melting on the drill bit. Despite this, the defendant instructed our client to remedy the situation by manually removing the melted plastic with a hammer and screwdriver.

Unfortunately, during the process, Mr. K’s hand slipped, resulting in injury. The defendant’s insurers disputed liability for the accident, asserting that our client failed to report any workplace incidents and was adequately trained in the reporting procedures. They also claimed that Mr. K was not instructed on machine cleaning procedures or trained in machine setup or tool changes.

Fortunately, the accident was captured on CCTV, which we successfully obtained. A telephone conference with a barrister was arranged to assess the claim’s prospects. The barrister concluded that our client had strong grounds for success, supported by the CCTV footage. Subsequently, the defendant’s insurers agreed to deal with the claim.

After our client underwent a medical examination to obtain a comprehensive report on his injuries, the claim progressed towards settlement. Mr. K was unable to work for two months due to his injuries and underwent remote physiotherapy treatment. Fortunately, his fractured ring finger healed satisfactorily within 18 months of the accident. He was delighted to receive £5,000 in full and final settlement for his injury and associated financial losses.
