Jeff Buck, who lives in Nottinghamshire, has received two Fixed Penalty Speeding Tickets as a result of parking his car in front of his own house! Unfortunately he lives in the immediate vicinity of a Fixed Speed Camera.
The unfortunate Mr. Buck parked his car in the road but, right in line with the speed camera. As he has no garage or drive he had no other alternative than to park on the road. His stationary vehicle was then caught on film “speeding” – in fact what happened was that other vehicles, exceeding the speed limit, triggered the camera and Police Officers failed to spot that his car was not moving at the time!
Speaking to the Nottingham Evening Post, Mr Buck said: "I assumed the first time it happened that the police would put something in place to prevent it from happening again.
I'm concerned now that every time someone triggers the camera I'll get these notices. I am amused by it but also angry that I have to go to the trouble of contacting the police."
Police have apologised to Mr Buck – he received his most recent apology in January 2010 when he asked to see photographic evidence that his car was doing 37mph on December 13 2009 with no driver aboard!
A spokeswoman for Nottinghamshire Police said “the camera is not faulty and Staff are being given guidance about the importance of verifying images.” Quite.
She added: "We hope that residents in this area appreciate that the camera is there to reduce the number of speeding motorists. We have written to Mr Buck to offer our sincere apologies for any inconvenience caused."
Mike Gray, Partner and Head of the Criminal Department at Oliver & Co said:
“This is obviously an amusing tale, save for Mr Buck, but it does show how important it is to never simply accept photographic evidence or, any evidence resulting directly from the operation of an automatic device. There have been numerous cases of these devices producing unreliable and bizarre results. That is why specialist Solicitors such as my Team are expert at testing and evaluating such evidence so as to ensure that our Clients are properly advised at all times. I can only assume that he and his visitors when approaching his house by car do so at a very modest speed!”
