Litigation Solicitor
John studied law at Manchester University and Chester College of Law and is a Solicitor in the Commercial Team specialising in Commercial Litigation , Professional Negligence and alternative means of Dispute Resolution including Mediation. He has vast experience of all manner of commercial disputes ( including as well Partnership and Shareholder disputes) and has often dealt with high value claims of in excess of £1 million.
John believes that the key to successful and cost effective litigation involves a careful analysis of the real matters in dispute and the development of a clear strategy with the client from the outset.
Particular cases of note include the following :-
1. The successful defence in it’s entirety of a complex and sizeable claim ( approx £1 million) involving allegations of breach of fiduciary duty, misappropriation, and corporate misfeasance , as well as a claim for an interest in a valuable property;
2. Summary judgement in favour of a Company that was sold defective agricultural supplies , and obtaining an interim payment of £150,000 as against the overall claim (£1.1 million in value). The Defendant company argued that the claim was an abuse of process and this claim was totally defeated without the need for a trial;
3. Mediating a complex and difficult Probate claim where the value of the Estate in question was £650,000 and some £200,000 of costs had already been expended by the Claimant’s Solicitors at an early stage of proceedings. The case settled that day and involved four parties including two residuary beneficiaries one being a Charity;
4. Without the need to issue proceedings and following the entering into of Pre-action correspondence , settling a Professional Negligence claim against a client’s former Matrimonial Solicitor for a sum representing 95% of the prospective claim on paper and within a period of two months after sending the initial Letter of Claim. The Claim had a potential value of £30,000;
5. On behalf of a widow ,and making application under the Inheritance ( Provison for Family and Dependants ) Act 1975, recovering some 75% of the Estate of her deceased and estranged husband , after a three day trial.
John holds a Mediation qualification and a Diploma in Commercial Litigation Practice.
In his spare time John enjoys travel abroad, country walks, socialising and has a keen interest in the Arts. Time permitting John intends to return to his former sport of fencing where he specialised in epee.
