Speeding Offences

Speeding is, without a doubt, the most common motoring offence, with many us having been caught speeding, and most of us having committed a speeding offence during our driving career.

There is an increasing number of speed detection units currently in use across the UK and it seems that every year the number of speeding offences increases. The first you might hear of being caught speeding is when you receive a Notice of Intended Prosecution through the post, or it could be that you are given a verbal Notice by a Police Officer. You may have been caught speeding by a fixed camera, or your speeding offence may have been captured by an officer with a mobile device.

Whichever method is used to capture and inform you of your speeding offence, you will probably want to avoid speeding fines and tickets, or even worse losing your license, and you may also be wondering what the process should be to avoid speeding tickets.

If you reach 12 points then you will be subject to a ‘totting’ disqualification unless you argue that you suffer exceptional hardship.  This is a technical argument and you are more likely to avoid speeding fines if you instruct a motoring offence solicitor.

If the speeding is deemed less serious then increasingly attending the speed awareness course is being offered as an alternative to penalty points, allowing you to avoid speeding fines. In other speeding offence cases a fixed penalty may be offered; or if the offence is regarded as more serious there may be a court summons.
There is always the option to dispute the offence and this will escalate the matter to Court. Once in court these issues can become very complex and it is often difficult to prosecute, meaning motorists can avoid speeding fines, but when prosecution is successful the penalties can be very high.

£2500 combined with 3-6 penalty points or a period of disqualification is the maximum speeding fine, and the main issue the prosecution faces is proving beyond reasonable doubt that the vehicle was speeding. For this to be proven, it is vital that the correct procedures have been followed and that the guidelines have been adhered to, and errors such as these have allowed many motorists to avoid speeding fines.

This is why enlisting the help of a specialist speeding solicitor is crucial to avoiding speeding tickets, as they are able to analyse the speeding ticket, and the process with which it was issued, and build a case to defend your speeding offence.

People We've Helped Avoid Speeding Fines

Speeding Offence  - In Devises speeding at 100mph, with our help the client avoided disqualification.

Speeding Offence - A client in Caernarfon avoided a ban whilst travelling at 106mph.

Speeding Offence - We dealt with a speeding offence where our client has received a 14 day disqualification for 102mph on a motorway and no penalty points and therefore saved his job.

Speeding Offence - We recently represented a young driver who was caught on camera at over 90mph in a 50mph zone. The client was a regional manager and losing his licence would have meant losing his job. We mitigated to the Court on his behalf to this effect and after lengthy representations the magistrates agreed to impose 6 points and a financial penalty instead of disqualifying him. Given the speed reading it is likely without our expert representation he would have been disqualified from driving with the personally disastrous consequences that this would involve. What made this result even more encouraging was that this was at a North Wales Magistrates’ Court and the reputation of North Wales in relation to speeding offences is well known

Speeding Offence - We successfully argued against disqualification on the grounds of exceptional hardship as a result of losing employment.

Speeding Offence - We achieved a not guilty verdict as a result of excess speed due to an emergency when trying to avoid an oncoming vehicle.
