Probate is the legal term for the authority to deal with a person's assets after their death, and it is Probate that grants that authority to the Executor. If there is no Will a grant of Letters of Administration needs to be applied for by one or more of the next of kin. This is effectively the same as the grant of Probate in that the Administrator has authority in law to collect the assets and distribute them according to the legal rules of Intestacy. Who gets what is determined by who actually survives the deceased.
