Divorce brings an end to a marriage so that man and wife revert to their single status. Judicial separation proceedings do not bring an end to a marriage but you are separated by an order of law and the law can provide division of the family assets, with the exception of pension provision.

The ground for a divorce is that the marriage is irretrievably broken down. This must be supported by one of 5 facts - adultery, unreasonable behaviour, 2 years separation with consent, desertion after 2 years and 5 years separation.

The court fees are payable when issuing and applying for decree absolute unless you qualify for fee remission.

Public Funding (Legal Aid) is available subject to your financial position.

If there are children of the marriage or children who have been treated as children of the family, the petitioner will provide details of with whom the children are to live, what level of contact the other party should have and what level of maintenance should be made.
