Dangerous & Careless Driving

Dangerous driving is a very serious motoring offence. Prosecution for a motoring offence of this magnitude could be dealt with in the Magistrates’ Court or often, the Crown Court.

In order to prove you have committed the offence, the prosecution will need to show that your driving was far below the standards of competency. They must also prove that it is obvious to a careful and competent driver that you were driving in a dangerous manner, and that there was considerable risk of damage or injury.

Similar to careless driving allegations, evidence against the defendant usually consists of witnesses statements, and often the defendant, using a traffic offence solicitor, will dispute the allegations being made. This is something that would have to be raised for the Court to consider for the trial.

If an accident has occurred- and often in other cases- then as part of your careless driving defence it may be necessary for an expert, such as a traffic offence solicitor to prepare reports on your behalf.

These are serious criminal allegations that in the Crown Court can result in a custodial sentence of up to 2 years or 6 months in the Magistrates’ Court. There is also a minimum period of disqualification of twelve months, and at the end of this period to have your license restored it is compulsory for you to pass an extended driving test.
